> ## Documentation Index > Fetch the complete documentation index at: https://docs.qumo-deploy.com/llms.txt > Use this file to discover all available pages before exploring further. # Terms of Service > Terms and conditions governing the use of Qumo Deploy services, APIs, and relay infrastructure. # Terms of Service **Last updated: September 2026** These Terms of Service ("Agreement") constitute a legally binding agreement between **Foalk, Inc.** ("Qumo", "we", "us", or "our") and the individual or legal entity accessing or using Qumo Deploy ("Customer", "you", or "your"). By registering an account, utilizing the Qumo Web Console (`console.qumo-deploy.com`), connecting to the REST APIs (`api.qumo.dev`), or deploying relays via our CLI/SDKs, you agree to be bound by this Agreement. *** ## 1. Services & Workspace Provisioning ### 1.1 Scope of Service Qumo Deploy provides an edge orchestration control plane, ephemeral credential management, and low-latency data forwarding network for real-time media and IoT protocols (including Media over QUIC and WebTransport). ### 1.2 Account & Tenant Security You are responsible for safeguarding your credentials, API keys (`qumo_live_...`), and Bot tokens. Any operation performed using your keys is deemed your authorized action. You must immediately notify Qumo of any unauthorized access or compromised keys. ### 1.3 Self-Service Limits Users are permitted up to three (3) active self-service tenant workspaces on standard tiers. Provisioning additional organizations requires approval or an Enterprise subscription agreement. *** ## 2. Acceptable Use Policy You agree not to use the Service to: 1. Violate any applicable local, national, or international laws or regulations. 2. Transmit unlawful, abusive, defamatory, infringing, or harmful media streams. 3. Conduct distributed denial of service (DDoS) attacks, port scanning, network crawling, or unauthorized penetration testing against Qumo or third-party infrastructure. 4. Attempt to circumvent bandwidth quotas, plan caps, or API rate limiting mechanisms. 5. Resell, white-label, or sublicense the control plane without prior written consent from Qumo. Qumo reserves the right to immediately suspend or throttle API keys or tenant accounts found in breach of this policy. *** ## 3. Subscriptions, Fees & Metering ### 3.1 Tier Structure & Included Quotas Subscription tiers (Free, Pro, Team, Enterprise) include specific monthly allocations of bandwidth, API keys, and machine bot accounts as detailed on our [Pricing & Plans](/console/billing) page. ### 3.2 Overage Billing Network bandwidth consumed beyond your plan's included quota is metered continuously and billed at your plan's published overage rate (e.g. $0.08/GB for Pro, $0.06/GB for Team). All payments are processed securely via Stripe. ### 3.3 Taxes & Invoicing All fees are exclusive of applicable sales tax, VAT, or withholding taxes. Unpaid balances past thirty (30) days may result in account suspension and revocation of active relay credentials. *** ## 4. Intellectual Property & Data Ownership * **Customer Content**: You retain full ownership and intellectual property rights in and to all media streams, payloads, and application data transmitted across the relay network. Qumo does not claim ownership or license rights over customer audio/video packets. * **Qumo Technology**: Qumo retains all rights, title, and interest in and to the control plane software, CLI binaries, SDK libraries, algorithms, trademarks, and documentation. *** ## 5. Service Level & Warranties * **"As-Is" Provisioning**: Except as expressly set forth in an Enterprise Service Level Agreement (SLA), the Service is provided on an "AS IS" and "AS AVAILABLE" basis. * **Relay Performance**: Network latency and edge routing depend on geographical proximity, public internet congestion, and third-party ISP routing. While Qumo optimizes routing topologies, we do not guarantee packet delivery guarantees on non-enterprise tiers. *** ## 6. Limitation of Liability To the maximum extent permitted by applicable law, neither party shall be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill) arising out of or related to this Agreement. Qumo's total cumulative liability shall not exceed the total fees paid by Customer to Qumo in the twelve (12) months preceding the claim. *** ## 7. Governing Law & Dispute Resolution This Agreement shall be governed by and construed in accordance with the laws of Japan, without regard to conflict of law principles. Any dispute arising from this Agreement shall be resolved in the Tokyo District Court as the court of first instance. *** ## 8. Modifications to Terms We reserve the right to amend these Terms from time to time. We will provide reasonable advance notice of material revisions via email or in-console notifications. Continued use of the Service following notice constitutes acceptance of the updated Terms.
